I think the sensible thing here is basically what you said before,
to set something like:

# CC-BY-SA 4.0, but only in countries where typefaces are uncopyrightable
PERMIT_PACKAGE =	Restrictively licensed in some countries
PERMIT_DISTFILES =	Restrictively licensed in some countries

Users in countries where it's freely licensed will have to build the
port manually, which is annoying but better than hosting the package
on mirrors in countries that don't permit it.
